Penalties for alcohol and drug use while driving

06 - 06 - 2015
Penalties for the use of alcohol and drugs while driving have been increased.

Because of the importance of drug and alcohol use in road accidents, the reform of the Road Safety Law took a step forward, raising the penalties and putting repeat offenders in the spotlight.

For such drivers, taken as such those who have been sanctioned in the immediately preceding year for testing positive for alcohol, the penalty is 1,000 € and the deduction of 6 points. Since the entry into force of the Law (May 9, 2014), the ATGC has issued 3,374 reports to this type of drivers.

This same sanction and detraction of points is also applied to those drivers who circulate with a rate that exceeds twice the allowed one. In the year that the new penalty has been in force, more than 30,000 drivers have been reported for driving with more than 0.50mg/l of alcohol in exhaled air.

For non-recidivists and for those who give a rate between 0.25 and 0.50 mg/l, the penalty is 500 € and the deduction of 4 points.

In the case of drugs, the law prohibits driving with the presence of drugs in the driver's body, excluding substances used under medical prescription and for therapeutic purposes. This infraction, classified as very serious, is punished with a penalty of 1,000 € and the withdrawal of 6 points. Since the Law came into force, 20,400 drivers have been denounced for driving with the presence of drugs.
